When people don’t pay their bills, we can assist in taking recovery proceedings. Options include filing proceedings in court to obtain orders for recovery of the debt from both individuals and companies.

The Local Court of NSW deals with amounts up to $60,000.00, usually for fixed legal costs and higher amounts can be recovered in the District or Supreme Courts.

In order to recover a debt, in many cases we can obtain an order to allow seizure of funds from a person’s bank account or we can obtain an order to seize property without notice to the person who owes you a debt.

Other alternatives include seizing the debtor’s wages from their employer so those funds are paid to you, or having the person declared bankrupt. In bankruptcy, a trustee is appointed to sell the debtor’s assets and to make payment to you.

If you are in debt

If you are in debt and are facing legal proceedings, we can also assist in negotiating on your behalf to arrange for either payment of a lower amount in lieu of the debt, or other options if the person whom you owe money to is seeking orders to have your wages taken to satisfy your debt. We can also make an application to the court to obtain the option to pay a debt by installments. There are other alternatives also open to you which we would consider and advise you on.
